Terms of service

These terms govern the working relationship between POMEGRANATE MARKETING LTD and its clients. They are short on purpose. Everything about price is already published on the service pages, so this document deals only with how the money and the commitment work.
Monthly plans
Monthly work is invoiced at the start of each month, before that month's work happens, and the work begins once the invoice is paid.
There is no minimum term, no contract length and no notice period. A month you have paid for is delivered in full; a month you have not is simply never started. If you decide the arrangement is not for you, tell us and there is no further invoice. Nothing is signed and nothing rolls over against your will.
Every plan is priced on its page, from SEO and Google Ads to web design. The figure you see is the figure invoiced, and it does not change because of anything you say on a call.
Websites and one-off projects
Half of the agreed fee is invoiced before design or development starts, and the balance on completion. Reasonable iteration is included within the agreed scope; work that materially changes what was agreed is quoted separately before it is done, never after.
When a website is finished, the domain, the hosting account and the code are in your name. There is nothing to buy back and nothing held hostage against a final payment.
Advertising spend
Advertising budgets are yours and are always separate from our fee. They are paid by you, directly to Google or to the platform concerned, on your own card and inside your own account. We never take a percentage of spend and we never invoice you for it.
The one exception is the Starter SEO plan, where we absorb the first £40 a month of Google Ads spend. That is a gift on that plan and is not a recommendation about what to spend.
Fees are not refundable
Once a month's work has started, its fee is not refundable, and we would rather set out the reason than simply assert it.
Marketing work is hours. A month's fee buys research, writing, building, campaign management and the time spent reading the results, and those hours are worked by real people and paid to them as they are worked. By the time anybody could ask for a refund the money has been earned as wages for work already delivered. As a contractor there is minimum wage legislation to stand behind, and recovering pay for hours that were genuinely worked is not something we are able to do.
What makes this fair is the other half of it, and the two belong together: nothing is committed in advance. There is no minimum term, no notice period and no penalty for leaving, so the most you can ever be exposed to is the single month you are in. If that month was not worth its fee, the next one does not happen.
This does not affect any statutory right you have where we have failed to provide the service with reasonable care and skill. If something has gone wrong, tell us and we will put it right.
What is free, and stays free
The written audit is free, whether or not you go ahead, and there is no invoice attached to it and no obligation of any kind afterwards. Ask for one on the contact page.
Charities, nonprofits and community projects can have the work done at no cost -- see the community projects page. Nothing is signed and no invoice is raised. Community interest companies are included for the brand work only, because a CIC can trade and pay salaries; the ongoing work is charged at our ordinary prices.
General
All prices are in pounds sterling and are the full amount payable. Invoices are due on the day they are raised unless something else is agreed in writing, and prolonged non-payment pauses work rather than accelerating it.
We may update these terms with reasonable notice. The date at the top of this page is the date of the version you are reading. These terms and any dispute arising from them are governed by the law of England and Wales.
